Reasonable doubt January 23, 2008
I tried to get out of jury duty. No excuse was good enough…they said I must report. So with threat of arrest Tuesday January 15th here I go to the Santa Ana Superior Courthouse.
My panel gets called up the 10th floor and guess who is Juror #1….c’est moi!
It’s a case of Road Rage. The actual charge was a 422 “willfully threatening to kill or cause great bodily injury to another person”. So it’s this good-looking young stud and this disabled old man who is an ex-cop & attorney at law. It’s a he said – he said kind of thing.
They brought in witnesses. Two on-the-scene civilians and two cops that took the reports after the fact. The “Victim” testified and the last person to testify was the defendant.
The “Victim” gave contradicting testimony with NO corroboration from the witnesses on the salient points of the case. The defendant testified and said he never said those things.
Reasonable doubt abounding.
The trial lasted four days. The deliberations lasted about an hour and a half. Not guilty.
This was an amazing experience!
